What U.S. States Allow Gambling?

The laws concerning the legality of online gambling in the United States are misunderstood. Many people have a hard time understanding what is prohibited and what is not. Most would argue about the clarity of the legislation. Therefore, answering the question "Which U.S. states allow online gambling?" can be difficult to answer.

The states that made online gambling illegal are Illinois, Nevada, Michigan, and Louisiana. Utah, California, Massachusetts, and South Dakota allow some forms of online gambling, but not every type. The Federal laws do not explicitly prevent individuals who are United States citizens from gambling online. The Internet Gambling Enforcement Act of 2006 was seen as a way to make online gambling illegal, though some argue that it doesn't to that.

The World Trade Organization ruled that the US was in violation of trade agreements by not granting full access to online gambling sites. Therefore many individuals are continuing to use online gambling sites. In fact, the majority of people using these online gambling sites are from the United States. Especially those who play online poker.

There are some states that have made online gambling illegal for different reason. Some are protecting their brick and mortar casinos, and have outlawed online gambling to protect those casinos. Many people say that the UIGEA prohibits online gambling. While others believe that the legislation makes it illegal for people in one state to bet against those in other states. The only particular type of gambling that is prohibited is professional sports betting. It doesn't make any other form illegal. Some experts in this particular legislation believe that the goal of the law was to curb organized crime and terrorism. The UIGEA was part of a larger act. The SAFE Port Act which made provisions to increase security measures in United States harbors. Gambling online could foster a new type of organized crime.

The language in the bill may not explicitly prohibit individuals from gambling online, it is illegal for some financial institutions based in the United States to process transactions going to online gambling sites. This can make it difficult for individuals to gamble online (companies that are traded on the London Stock Exchange have stopped American players because of the UIGEA legislation) However, many players have circumvented those rules.

There are still online casinos that do allow American players to become members of their web site and there are still financial institutions that will make payments to and accept them from online gambling web sites. So which states in America allow online gambling? This can be a difficult question to answer. Some say that online casinos are not illegal for United States citizens.

Others would claim that the law does prohibit such actions. It would be best to contact a legislator in your state regarding the legality of online casinos, or speak to the gambling sites customer service to see if they can help. In most cases, they will either not know or will not be willing to make a judgment call. It will be your responsibility to know the laws that govern the state and country where you live.
